Kalwa youth sentenced to 5 years rigorous imprisonment

A 21-year-old youth from Kalwa was held responsible for the death of his room mate in 2013 and sentenced to five years rigorous imprisonment by Thane Additional Sessions Judge A S Wagwase here today.
The judge held the accused Abdul Rahim Jamluddin Ali, guilty under Section 304 (1) of the Indian Penal Code and sentenced him to the jail term.
Prosecutor Buleshwar Hinge who appeared for the prosecution told the court that the accused and the deceased Arshal Anwar Khan, 21, had gone to Hyderabad.
On July 8, 2013, they went to Kalwa and stayed with a group of youths.
It was alleged that there was a dispute between the two of them over payment to be made for work done in Hyderabad and the accused had demanded the same from the deceased.
On the night of July 9, 2013, the accused attacked the deceased who was asleep with a hard and blunt object as well as strangulated him.
Other room mates rushed the injured to a hospital where doctors declared him brought dead, the prosecution told the court.
The defence counsel submitted that the accused had become insane after he was lodged in jail.
The prosecutor who examined two doctors and the father of the accused disproved the pleading based on the evidence on record, an extra-judicial confession and other proof.
The court held the accused guilty of culpable homicide not amounting to murder and sentenced him to five years rigorous imprisonment.
