The tribunal directed New India Assurance Company Ltd, with which the tempo was insured, to pay Rs 30,77,788 as compensation to the wife, minor son and parents of Delhi resident Ravi Bharti who died in 2012.
"The issue stands decided in favour of petitioners (family) holding that the accident happened as a result of negligent driving by respondent no. 1 (tempo driver) in which Ravi Bharti had received fatal injuries," MACT presiding officer Ravinder Bedi said.
Due to the forceful impact, he fell down on the road and sustained grievous injuries. He was taken to a nearby hospital but he died during the treatment.
The victim's family members, residents of Mayur Vihar here, had approached the tribunal seeking Rs one crore as compensation.
They had said Bharti was earning Rs 10 lakh per annum but as per records, his income came out to be over Rs five lakh.
