Citing lack of mechanism to control infection during dialysis to patients in the Stanley Medical College Hospital here, Madras High Court has said it expected that adequate interim compensation would be paid to affected persons before the next hearing failing which the Health Secretary should present in the Court.
A PIL was filed in the High Court earlier stating that some kidney failure patients receiving dialysis at the government run hospital contracted hepatitis C(HCP) due to negligence on the part of doctors.
The Court then ordered issue of notice to Tamil Nadu government calling for a report and inquiry on the matter besides asking the hospital authorities to explain their stand on paying compensation to the affected persons.
When the mater came up yesterday, the first bench comprising Chief Justice Sanjay Kishan Kaul and Justice T S Sivagnanam, after going through the affidavit filed by the Health Secretary opined that the statement "speaks only about the remedial measures took".
The bench said there is lack of fool proof measures in infection control measures. "Naturally a question which arises is the extent of compensation to be paid to the suffering patients over which the authorities are conveniently silent," despite the court's earlier specific direction.
"We expect that before the next date of hearing adequate interim compensation would have been paid to the affected parties failing which the Health Secretary should remain present in the Court" and posted the case to June 11.
