Law Minister writes to CJs on speedy trials of heinous crimes

He said a fortnight back he had written to the CJs of High Courts and wrote another follow-up letter to them as well as Chief Ministers regarding establishment of Fast Track Courts (FTCs) in the states on priority.

Kumar told reporters here that FTCs need to be created for concluding expeditious trial in cases involving sexual assault on women.

He talked about the proposal to permit use of funds earmarked for morning, evening or special courts, for establishments of the FTCs.

Kumar said he has also written that 10 per cent of the additional positions would be created at district and subordinate courts for which 50 per cent of the expenditure will be shared by the Central government.

To ensure effective implementation of various Sections of the Code of Criminal Procedure, he said under existing laws there was a provision that adjournments under certain sections cannot be given.

Amid clamour for death penalty for rapists in view of the recent incident of gang-rape of a young woman inside a bus in Delhi, Kumar said there were different views and opinions which had come in the wake of the incident.

He also said that in an effort to fast-track the hearing of rape-related cases, there was a need to strengthen the number of judges in the lower judiciary for which the government was making efforts.

To another question whether capital punishment would be a deterrent for those who commit heinous crime like rape, he said, "...It would be left to the wisdom of the Justice J S Verma committee to recommend."
