Maha for providing protection to whistleblowers

A division bench of Justices A M Khanwilkar and K K Tated was hearing a suo motu petition taken up in 2010 after the murder of Pune based RTI activist Satish Shetty.

The court had suggested the government in the last hearing to consider framing of comprehensive guidelines for the protection of witnesses and whistleblowers.

Additional government pleader Nitin Deshpande today informed the court that the state was considering to frame a policy and on providing protection to whistleblowers and activists facing threat to their lives.

Meanwhile, an intervening application has been filed by a Kolhapur-based organisation 'Prajasattak Samaj Seva Sanstha' seeking implementation of a Government Resolution for providing protection to witnesses, activists and whistleblowers.

The application stated that the government was not sensitive towards complaints made by social activists.

The matter has been posted for hearing on February 18.

In May 2010, the high court after going through the recommendations made by the amicus curie laid down certain measures to be undertaken by the government and directed for a committee to be set up to look into the issue.

But the state government had not acted in the matter.

The state government was directed by the high court to set up a special committee to undertake the task of identifying social activists and whistle blowers.

"These activists shall be identified by a transparent process and guidelines for the determination of the same shall be formed by the committee," the order said.

It further said the government shall provide police protection to any identified social activist/ whistleblower or organisation that complains of threat or having been attacked.

"A database has to be prepared of names of all activists who have in the past complained of threat. This database shall also include names of high risk activists," the order said.
