Metropolitan Magistrate Manika absolved South Delhi resident Mahender of stealing complainant Ankit Wasan's car, mobile and credit cards at gunpoint, in collusion with two others in March.

"He (Wasan) has failed to identify the accused as one of the persons who had allegedly kidnapped him and snatched his Alto car. The prosecution has clearly failed to prove the charge against the accused," the judge said.

The court noted the complainant had deposed that he had not seen the faces of the accused and could not identify them.

According to the prosecution, on March 19 three people in a car blocked Wasan's vehicle near Najafgarh when he was driving back home to Uttam Nagar from his office in Gurgaon. The trio alighted from the car, overpowered him using a gun and blindfolded him.

Wasan had told the court that he was taken to the other car. The assailants robbed him of his belongings and drove him for two-three hours before dumping him at a secluded spot.

Mahender was later arrested, while the other two could not be traced.
