Man becomes disabled in accident, gets Rs 38 L compensation

A man, who became permanently disabled and paralysed after a rashly driven truck hit his vehicle, has been awarded a compensation of over Rs 38 lakh by a Motor Accident Claims Tribunal (MACT) here.
The tribunal directed the Oriental Insurance Company Ltd to pay Rs 38,09,382 to victim Sanjay Yadav whose lower part of the body became paralysed due to the accident in 2010.
The tribunal said the accident had taken place due to the rash and negligent driving of truck driver Chet Ram.
"In view of the evidence on record preponderance of probability is that accident took place due to rash and negligent driving of the offending vehicle by Chet Ram," MACT presiding officer Rekha Rani said.
"It cannot be disputed that petitioner (Yadav) has become paraplegic on account of the injuries sustained by him. He has become life long handicapped.
"It is also true that no amount of compensation can restore his broken and shattered physical frame. It is really difficult to assess the exact amount of compensation for the pain and agony suffered by the petitioner," the tribunal said and noted that he has suffered 100 per cent disability.
On November 2, 2010, Yadav, a resident of Jahangirpuri, was riding his motorcycle and his father was a pillion rider. On reaching near Adarsh Nagar, when he was taking a left turn, the offending truck driven by Ram came at a speed and rammed into his vehicle. Due to the impact, Yadav and his father fell down. Yadav received grievous injuries in the mishap and was taken to a hospital by his father.
While awarding the compensation, the tribunal noted that Yadav has become bed ridden and has lost control over lower part of his body.
