The tribunal directed United India Insurance Company Ltd, insurer of the offending car, to pay Rs 10,60,791 to Shahdara resident Rakesh Kumar, who was on his motorcycle when the Tata Sumo hit him in 2008.
"Considering the certified copies of the charge sheet, evidence of Rakesh Kumar, I am of the considered view that the accident had been caused by rash and negligent driving by car driver..." MACT Presiding Officer Anoop Kumar Mendiratta said.
Kumar, an electrician, was taken to Dr Ram Manohar Lohia hospital where he was treated for fracture in right leg and suffered nearly 50 per cent permanent disability in his leg, it said.
Kumar had sought compensation of Rs 11 lakh on the ground that he earned a salary of Rs 13,000 per month before the accident but he would not be able to earn that much in future due to his disability.
The insurance company had contended that the petition made false claims and the compensation amount of Rs 11 lakh sought by Kumar was excessive and exorbitant.
