Additional Sessions Judge Sanjiv Jain, while freeing the man, referred to the testimony of the complainant before the court in which she said she made false rape allegations on the advice" of her lawyer who said it was the only way to get the money back.
"The necessary ingredients of the offence with which the accused has been charged are not proved against him," the court said.
"I did not find any purpose to examine other witnesses/ police officials as their testimony even if unrebutted could not become the basis of the conviction of the accused," the judge said.
"She stated that she had given her statement under section 164(statement before magistrate) of CrPC on the advice of her counsel as per the contents of her complaint. She stated that the accused has started paying her the instalments," the court said.

According to the prosecution, the man, who is known to the complainant, had borrowed Rs 3 lakh from her for some business purposes. She also purchased a mobile phone worth Rs 46,000 for him.
The woman turned hostile during the trial and informed the court that it was her lawyer's idea to frame him.
Her testimony read that she had a quarrel with the accused over the money he owed her but the same was settled after he assured to return it in instalments.
The statement of the accused was dispensed with since there was no evidence against him, the court said.
