Man gets 5-yr jail term in attempt to murder case
Press Trust of India New Delhi A Delhi court has sentenced a man to five years in jail for stabbing his friend while he was trying to pacify him during a quarrel observing there was no justification in inflicting such a deep wound on someone who was only asking him to forget the past.
District and sessions judge Asha Menon handed down the jail term to south Delhi resident Manoj while holding him guilty of the offence of attempt to murder under the IPC.
The judge also refused to show any leniency towards him on the ground of poverty considering that the victim too was from the same background.
"There had been a quarrel amongst the friends and the injured had only tried to pacify him. The response of the convict was not at all commensurate with any action of the injured which the convict may have considered hostile to his interest. There was no justification at all in the convict inflicting such a deep wound on the victim for asking him to forget the past.
"Poverty alone would not be extenuating circumstance in view of the fact that the injured also belongs to the same background as the convict," the judge said.
The court also imposed a fine of Rs 10,000 on Manoj and directed the Delhi Legal Services Authority (South) to provide relevant compensation to the victim.
According to the prosecution, on July 16, 2015 at Sangam Vihar here, the accused had a fight with his friend and when victim Manish intervened and tried to resolve the dispute, Manoj stabbed him with a knife causing a life threatening injury.
"Prosecution has proved the case completely against the accused that he stabbed the injured with a knife in a manner that had death been caused he would be guilty of murder," the court said.
During the proceedings, the accused had pleaded innocence and claimed he was falsely implicated. After conviction, he sought leniency from the court on the ground that he was poor.
The court, however, rejected his contentions and said, "In the totality of the facts and circumstances of this case, the convict is sentenced to rigorous imprisonment for a period of five years and to a fine of Rs.10,000.
