Man gets 6 months jail term for betraying employer's trust

Metropolitan Magistrate (MM) Chhavi Kapoor sentenced 42-year-old Rajesh Kumar after holding him guilty of breaching his employer's trust by not delivering the cash and valuable given to him by his employer to his requisite customers and misappropriating the same.

The court gave milder sentence to Rajesh, observing that he had performed his duties diligently in the past and had never before betrayed the trust reposed in him. The court also imposed a fine of Rs 1,000 on him.

"The offence under section 408 (criminal breach of trust) of the Indian Penal Code is punishable with a maximum period of imprisonment of seven years and fine. It has come on record that convict was employed by the complainant for delivery of goods and cash on earlier occasions also but he had never committed breach of trust before this incident.

"Complainant has nowhere alleged that the convict has a bad character or did not attend to his duties diligently. Nonetheless, the convict has been found guilty of breach of trust reposed in him by his employer. Therefore, I sentence the convict to rigorous imprisonment for a period of six months and a fine of Rs 1,000," MM Kapoor said.

The convict while pleading for leniency had said he had been facing trial for last more than 11 years and regrets doing the act, adding that his family is dependent upon him for their day-to-day needs. (MORE)
