The court refused to show any leniency to convict Kailash Singh, a resident of Bijwasan in south west Delhi, saying he does not have any respect for the dignity of women. His associate Jairam has been absconding since then.
"The crime committed by the convict cannot be said to be jejune (insignificant). It seems that he along with his associate were roaming like hungry wolves, in the look out of a prey to satisfy their sexual lust and as soon as they found the prosecutrix sitting alone in an isolated area, their eyes shown bright and took her forcibly to the tenanted room of the convict," Additional Sessions Judge Virender Bhat said.
The court, however, said mere inefficiency or negligence of IO in conducting probe cannot be made a ground to throw out the prosecution case which, otherwise, is established beyond doubt from the deposition of prosecution witnesses.
It also imposed a fine of Rs 40,000 on Singh and said if realised, the amount be given to the victim. He was held guilty for the offences under sections 366 (abduction) and 354B (assault or use of criminal force to woman with intent to disrobe) of the IPC.
