Additional Sessions Judge M C Gupta awarded the jail term to Sultanpuri resident Raj Kishor saying it has been clearly established that he had developed physical relations with the girl without her consent and rejected his plea that there was a delay in lodging of FIR which showed that he was falsely implicated.
"The sight cannot be lost of the fact that the Indian women has tendency to conceal offence of sexual assault because it involves her prestige as well as prestige of her family. Only in few cases, the victim girl or the family members has courage to go before the police station and lodge a case," the court said.
"The testimony of the girl is found to be clear, natural, cogent, trustworthy, inspiring confidence and having a ring of truth," it said and imposed a fine of Rs 10,000 on Kishor.
According to the prosecution, Kishor had raped the girl on November 1, 2011, when she was alone at her house. The girl had told the police that the accused used to stalk her from past few months and on the day of the incident, he entered her house and tried to make her unconscious before raping her.
The girl had informed her mother over phone as she was out of town and after returning to Delhi, they had lodged a complaint against Kishor at Sultanpuri police station.
