Additional Sessions Judge Sanjay Garg jailed 31-year-old Raju Day saying that he does not deserve any leniency because he raped his daughter as and when he got the opportunity. The court also imposed a fine of Rs 2,000 on him.
"It is a case of incest as the girl is his real daughter. As per the victim, when her mother was away to her parents house, accused raped her two-three times. The accused continued this inhuman act as and when he got an opportunity, even after his wife and girl's mother returned back.
"The convict has abused the pious relation of daughter and father. It is not a case of isolated incident, the convict sexually abused his daughter as and when he got the opportunity," the judge said.
The prosecution case dated back to January last year when the victim's mother had gone to Kolkata to her maternal house and she was living here with his father Raju and three siblings at Mandawali in East Delhi.
One day when they all were sleeping, her father raped her and also threatened her not to tell this to anyone, the prosecution said adding that till April 27 last year, when the victim's mother lodged the complaint with police, Raju had raped the girl five to six times.
He continued raping his daughter even after she had told about her father's acts to her mother, the prosecution told the court.
In his defence, Raju told the court that he was falsely implicated because his wife used to indulge in prostitution and was trying to push their daughter into the same but when he objected to it, she filed a false case against him. (MORE)
