Additional Sessions Judge (ASJ) Pawan Kumar Jain waived West Delhi resident Narender Kumar's sentence for bouncing of his cheque worth Rs 2.6 lakh after he and complainant Atul Kumar Pandey told the court that they have amicably arrived at a settlement.
"It becomes clear that both the parties have settled their dispute amicably and voluntarily and admittedly, both the parties are close friends.
"To maintain harmony between the parties, I am of the view that ends of justice will meet, if appellant (Kumar) be released on probation," the ASJ said.
The sessions court order came on an appeal by Kumar against the trial court order, sentencing him to eight months in jail in June year and also directing him to pay a fine of Rs 5.2 lakhs for dishonouring the cheque worth Rs 2.6 lakhs.
It had asked him to pay Rs four lakhs as compensation to Pandey out of the fine amount.
The trial court had sentenced Kumar saying he could have chosen to make the payment within 15 days of the receipt of the legal notice from the complainant, but failed to do so.
The ASJ, however, modified the order of the magisterial court observing that Kumar had already deposited a cheque of Rs 2.6 lakhs with the trial court and had also paid an amount of Rs 40,000 to the complainant in the court.
