Married daughter of deceased employee eligible for appointment

The Madras High Court has made it clear that a married daughter of a deceased government servant is eligible for appointment on compassionate grounds subject to submission of no objection certificate of the other members of the family.
A division bench, comprising Justice Satish K Agnihotri and Justice M Venugopal, disposed of an appeal filed by the authorities of the Education Department of Tamil Nadu government recently against the order of a single judge.
The single judge had on June 4 last year directed the authorities to consider grant of compassionate appointment to one Kayalvizhi, daughter of V Indrajith who died while working with the Education Department.
The division bench in its order said "while considering the representation of the married daughter of the deceased government employee, the authorities may direct the said person to produce the undertaking from her and her husband to the effect that she will take care of the other members of the parents family."
The Department had refused to appoint Kayalvizhi on the ground that she was a married woman.
The single judge in his order had said that Kayalvizhi was the only daughter of the deceased and having no other source of income. Though she is married, she is eligible for consideration of appointment as marriage is not a disqualification.
The Education Department filed an appeal against the single judge's order.
The division bench, after referring to various earlier orders of the Madras High Court, said in its order "a married daughter is eligible for consideration subject to submission of no objection certificate of other members of the deceased family and also with an undertaking from her and her husband that they will take care of the other members of the family."
The bench also directed the Education Department to pass orders within of four weeks.
