Masood murder: Court reserves ruling on bail plea of accused

Special Judge Anupam Srivastava reserved the judgement after hearing the arguments of Saba's lawyer Sunil Srivastava and those of Senior Public Prosecutor Hemant Shukla.

The court also decided to hear the bail plea of main accused Zahida Pervez, an interior designer, on August 23 as the Public Prosecutor sought time to send the application to the CBI headquarters in Delhi for preparing arguments.

Zahida filed for bail on August 10 on the ground that she has two minor daughters who needed her immediate attention. She also pointed out that she had been in police or judicial custody for the last six months.

Meanwhile, acting on an earlier court directive, CBI, which probed the high-profile case, today provided a set of 21 photos of Masood, forensic and post-mortem reports and details of evidences to five defence lawyers.

Arguing for bail to Saba, her lawyer maintained the CBI chargesheet does not have evidence to link her client to the murder. Srivastava said the agency has failed to clarify the role of her client in recovery of a motorcycle allegedly used in the commission of the crime.

Saba, a close friend of Zahida, has been charged with abetting the murder of the RTI activist here last year.

The defence lawyer also challenged the destruction of evidence charge levelled against her.

In her bail plea, Saba has also sought relief on medical grounds, saying she was suffering from spleen disorder and no one in the jail was taking care of her.

The Public Prosecutor assured the court that medical facilities would be provided to Saba as per the jail manual.

Shukla said since the trial is set to start from August 30, bail should not be granted to her at this stage. He said enough evidence is available against the accused.
