The magistrate's court, which granted the bail, had said Mehta should submit his passport and not leave the country without the court's permission.
Justice M L Tahaliyani has now directed that Mehta should intimate the ED before leaving the country.
The case dates back to 2002. According to ED, between 1995 and 2002 Mehta's firm purportedly exported diamonds worth USD 20 million, but no money was remitted to his account.
It had got a non-bailable warrant against him from the court saying he was not complying with the summons. Mehta was arrested on November 26 this year and the court granted him a bail of Rs 2 lakh.
