The 33-year-old actress filed for divorce from her second husband, a concert promoter, in January just 18 months after they wed, reported TMZ online.
The former couple's separation proceedings are ongoing and Sestito filed court documents last week claiming he has "negative balances" on both his business and personal accounts and is asking to be awarded USD 17,000 a month in spousal support.
The documents state that Sestito became accustomed to eating out "almost every day at high end restaurants" and estimates his monthly food bills to be around USD 3,000 a month.
Sestito claims Suvari's annual income to be around USD 750,000 and he also wants to be given an additional USD 10,000 to pay his attorney fees.
The actress' lawyer Mark Gross said, "It is unfortunate that Simone has chosen the spotlight of litigation over the privacy of mediation."
Suvari was previously married to cinematographer Robert Brinkmann. Their five-year union ended in divorce in 2005.
