The postponement of the Australian and New Zealand legs of The Rolling Stones' tour came after Jagger took doctors' advice not to perform for a month.
Scott's underwriters claim that because she committed suicide they do not have to pay out 8 million pound that the band are demanding from the 17 million pound policy.
Jagger's condition came to light as a result of court papers in the ongoing legal battle over insurance.
