Minor's conduct questioned, man freed in attempt to rape case

A man accused of trying to rape his 11-year-old neighbour has been acquitted by a Delhi Court which said the minor's conduct after the incident was not that of a "sexually assaulted girl".
Additional Sessions Judge Virendra Bhat, while acquitting Mohan Chand Joshi, an architect, said "the prosecution's case was not only doubtful but also highly improbable."
"The conduct of the girl after the incident also does not indicate that she had been subjected to sexual assault in the flat of the accused. She did not raise any alarm when he was dragging her towards the kitchen or when she was being assaulted sexually by him in the kitchen," the court said.
According to the prosecution, on August 31, 2011, the girl along with her brother went to Joshi's house to play with his daughter.
While she was waiting for her friend in the drawing room, Joshi came from behind, caught her and dragged her into the kitchen and attempted to rape her, it said.
Thereafter, the girl went to the roof of the man's house and played with her daughter.
When the minor returned home, she narrated the incident to her mother, who informed the police, the prosecution said adding that a case was registered against the man at Dwarka police station here.
