SAD general secretary Maheshinder Singh Grewal, in a statement here, said it was absurd to demand that a case be registered against an owner of a bus whose employees had committed a wrong doing.
He said in legal jurisprudence, only the person who has committed a crime is liable to face prosecution.
"The law of vicarious liability under law of torts is only applicable in civil matters," he said.
Family members of the victim and opposition parties have been demanding registration of a case against Deputy Chief Minister Sukhbir Singh Badal and cancellation of permits of Orbit Aviation.

He urged all the political parties and people to have faith in Chief Minister Parkash Singh Badal, who has directed that strictest possible action against the accused.
He also accused Congress and AAP of trying to gain political mileage out of the tragic incident.
"It was unfortunate that Congress and Aam Aadmi Party were trying to use the tragic demise of a teenage girl as a political tool to reclaim lost political ground," he said.
"The sincerity of the government can be gauged from the fact that the two prime accused were arrested immediately and booked under Section 302 of the IPC," he said.
