Naroda case: Court issues notice to SIT to file report

Designated court judge Jyotsana Yagnik today issued notice to this effect and asked the SIT to file a reply by June 14, which is next date of hearing.

The NGO, Jan Sangharsh Manch (JSM) had filed an application under section 173(8) of CrPc before the court for further investigation into Naroda Patiya case with regard to larger conspiracy under section 120-B (punishment of criminal conspiracy) of IPC.

JSM had also prayed to find out connivance and/or criminal negligence by the officers of the police department which resulted into death of a large number of persons and destruction of their property and analysis of telephone call data contained in CD produced by IPS officer Rahul Sharma.

Appearing for the applicant Jan Sangharsh Manch, advocate S H Iyer urged before the court that initially SIT carried out further investigation but no report, as required under section 173(2) of the CrPC, has been submitted despite specific order of the Designated Special Court dated December 3, 2011 to forward final report to the court.

It was therefore necessary in the interest of justice to direct the SIT to submit report under section 173(2) of CrPc in respect of further investigation which has been carried out by the agency, Iyer said.

In all 98 people of minority community were killed in the Naroda Patiya area of the city during 2002 post-Godhra riots. Former BJP minister Maya Kodnani, VHP leader Jaydeep Patel and Babu Bajrangi are accused in the case.
