It is stated in the lawsuit that Loeb, 39, wanted to preserve the embryos while Vergara, 42, did not agree to it, reported Aceshowbiz.
The former couple, in 2013, reportedly had in vitro vertilization which produced embryos from Loeb's sperm and Vergara's eggs. They used a surrogate to implant the embryo but they split before the embryo was successfully implanted in her.
The document in which Loeb is referred to as pseudonym John Doe, and Vergara as Jane Doe states, "John seeks to save from destruction two cryopreserved Female Embryos created using John's sperm and Jane's ova for the purposes of attempting to have children. However, before the Female Embryos could be implanted in a surrogate, the Parties ended their relationship."
An insider said Loeb's feelings on the preservation of the fertilized eggs were tied to his political beliefs, "He has been a Republican his entire life and has always believed that life begins at conception."
"Nick is very emotionally invested in these female embryos because he's pro-life and believes life begins at conception," the source said.
The document claims that Vergara was "physically and mentally abusive." It is written in the document, "She punched him in the face on two occasions, kicked him, and threw her phone at his head. She also routinely bullied him, calling him a 'loser,' 'worthless' and other degrading names.
