The issue surfaced during a hearing before the Central Information Commission on a plea of Subhash Agrawal who sought these documents from the apex court.
The respondent said that there are 193 working days but they do not have record as to how the tradition of summer leave started.
"It has emerged that respondent does not have the record regarding tradition of summer vacations starting in the Supreme Court. Further, this matter was transferred by the Justice Department to the Supreme Court. This, inter alia seems to show that they do not have any records in the matter," Chief Information Commissioner R K Mathur noted.
"In the instant case, neither the respondent nor appellant are confident about the holding authority of such information. In such a case, it would not be possible for the respondent to transfer the application to any other public authority," he said.
