The observation was made by Justice S Satishchandran while closing a writ petition filed by Mariyu, widow of Mohamed Fazal, seeking a direction to the government to conduct an "effective and meaningful" investigation for bringing to light all conspirators involved in the murder.
Mariyu had alleged that former Home Minister Kodiyeri Balakrishnan was privy to the conspiracy that led to her husband's murder on October 22, 2006.
Immediately after the murder, Kodiyeri had declared that RSS was responsible for the same, she had stated.
CBI was not taking steps to unravel the deeper conspiracy and conspirators at higher levels, she alleged, while also accusing that the "pressure tactics" of CPI-M was confining the investigation to a certain level.
While terming her apprehension as unfounded, the Court said CBI had to be given a free hand to conduct the investigation and there was no reason to hold that it would yield to pressure.
According to the prosecution, a group of assailants had attacked CPI(M) worker Fazal, allegedly as part of a controversy, after he switched over to NDF.
Six of the eight accused have so far been arrested in the case.
