No offence made out under our jurisdiction: Delhi Police to

Delhi Police today told a court here that "no cognizable offence" was made out under its jurisdiction as alleged in a plea seeking lodging of an FIR against RSS chief Mohan Bhagwat, VHP leader Praveen Togadia and SP leader Azam Khan for allegedly making "hate speeches".
In an action taken report (ATR) filed before Metropolitan Magistrate Snigdha Sarvaria, police said they have sent the complaint to Mumbai Police on September 17 as the alleged incident had taken place there.
"....It is submitted that there was no incident mentioned in the complaint which ever happened under the jurisdiction of Tilak Marg Police Station. The entire incident took place in Mumbai. So the complaint was sent to Mumbai on September 17... No cognizable offence (is) made out under jurisdiction of Tilak Marg Police Station," the police said.

The court had earlier directed the station house officer of Tilak Marg Police Station to file an ATR on a plea filed by Kamran Siddique who had alleged that "Bhagwat, Togadia and Khan willingly and deliberately with intention to disturb peace in India tried to distort the communal harmony while promoting enmity between different groups on the ground of religion and region".
The court has fixed the matter for hearing on October 7.
The complainant has sought registration of FIR against Bhagwat, Togadia and Samajwadi Party leader Azam Khan alleging that police have not taken any action against them till date.

In his plea, the complainant alleged that Bhagwat had, while speaking at a public function in Mumbai on August 17, termed India as a "Hindu Rashtra" and Togadia, who was also there, had "insisted to get Ram Mandir at the disputed site (Ayodhya)".
Reacting to their statements, Khan had allegedly asked Bhagwat regarding the "Map of Hindu Rashtra", the complainant had claimed.
"It is, therefore, prayed that this court may be pleased to call the report of the SHO and the IO of police and direct them to take legal action against the aforesaid accused persons in the interest of justice," the complainant said in his plea.
