In an action taken report (ATR) filed before Metropolitan Magistrate Snigdha Sarvaria, police said they have sent the complaint to Mumbai Police on September 17 as the alleged incident had taken place there.
"....It is submitted that there was no incident mentioned in the complaint which ever happened under the jurisdiction of Tilak Marg Police Station. The entire incident took place in Mumbai. So the complaint was sent to Mumbai on September 17... No cognizable offence (is) made out under jurisdiction of Tilak Marg Police Station," the police said.
The court has fixed the matter for hearing on October 7.
The complainant has sought registration of FIR against Bhagwat, Togadia and Samajwadi Party leader Azam Khan alleging that police have not taken any action against them till date.
Reacting to their statements, Khan had allegedly asked Bhagwat regarding the "Map of Hindu Rashtra", the complainant had claimed.
"It is, therefore, prayed that this court may be pleased to call the report of the SHO and the IO of police and direct them to take legal action against the aforesaid accused persons in the interest of justice," the complainant said in his plea.
