The Lucknow bench of the high court, while rejecting the PIL, observed that there was no reason to entertain it.
A division bench of Justice Amreshwar Pratap Sahi and Justice Arvind Kumar Tripathi passed the order on the PIL filed by the Emergency Legal Aid Advocate Welfare Society through its president.
Another direction was sought in the plea for issuing necessary direction to form a Special Investigation Team, which would inquire the whole scam on the basis of CAG report.
The PIL was opposed by counsel for CBI, who contended that this is a proxy petition on behalf of the scam accused, who are somehow or other trying to stall the trial.
"This court in the exercise of writ jurisdiction will not enter into the issue of the status of the evidence or any further evidence, which has been collected by the prosecution that would be subject to trial," the court, observed while rejecting the PIL.
