Additional Sessions Judge Surinder S Rathi reserved its order on plea by Kazmi, who has been arrested for his alleged role in a terror attack on the Israeli diplomat and is presently lodged in Tihar jail.
The jurno had moved the sessions court against Chief Metropolitan Magistrate Vinod Yadav's June 2 order, which had allowed the Special Cell to complete its probe in 180 days, extending the probe period from 90 days to 180 days.
Kazmi's counsel Mehmood Pracha earlier argued to the court that he was not given a notice of the police plea for extension of the probe period.
He added that on June 2, Kazmi's judicial custody had expired and before extending his remand, the CMM had extended the probe period.
Pracha told the court that on June 2 he was allowed by the court to conduct a 30-minute legal interview with his client Kazmi and the application for extension of his custody was moved behind his back.
"The application was considered in-camera, where I was not heard. The order was passed in a surreptitious manner behind our backs." he said.

Additional Public Prosecutor Rajiv Mohan, however, argued that Kazmi and his counsel were present in the courtroom when the order was passed on June 2 and their presence had excluded the need of giving them any notice.
Kazmi was arrested by the Special Cell of Delhi Police on March 6. He completed 90 days in custody on June 5. The police, however, did not file the charge sheet saying it is still investigating the matter.
It then sought extension of probe period by 90 days, which was allowed by the CMM on June 2.
