The parents of a 21-year-old youth, who died in a road accident involving a rashly driven truck, have been awarded a compensation of over Rs 30.5 lakh by a Motor Accident Claims Tribunal (MACT) here.
The tribunal directed National Insurance Company Ltd, with which the offending truck was insured, to pay Rs 30,51,000 to the parents of Priyanshu Soni, who died in March 2010.
The tribunal said there was no contradiction in the statements of witnesses, including an eyewitness, and nothing could discredit them.
"The testimony of prosecution witnesses remains unshaken and without any divergence. Both the witnesses have clearly stated that deceased met with an accident from a truck which was being driven by respondent no. 1 namely Subhash at a very high speed in rash and negligent manner.'
"Nothing has been asked which could impeach the testimony of the witnesses. Nothing came out on record which could improbablise the sequence of events. Apart from this nothing has been elicited in cross examination to demolish the testimony. The testimony given by both the witnesses are reliable, trustworthy and believable. The criminal record of the case further supports and corroborates the case of the petitioner (victim's parents)," MACT Presiding Officer Deepak Jagotra said.
According to the parents' petition, the accident took place on March 7, 2010 when Priyanshu along with his friend was going on his motorcycle from Bijwasan to Sarojini Nagar and the speeding truck, driven in a rash and negligent manner, hit them from behind.
Due to the impact, Priyanshu and his friend fell down and he received fatal injuries.
The woman, who was travelling with the victim and an eyewitness, told the tribunal that when they reached a place near Dhaula Kuan, their motorcycle was hit by the truck from behind. Due to the injuries, Priyanshu died.
The victim was working as a marketing manager in a private catering firm here and was earning Rs 28,000 per month.
