Paternity row: Tiwari seeks shifting of case out of HC complex

N D Tiwari today asked the Delhi High Court to hold his cross-examination, in a paternity suit filed by a youth seeking to declare the Congress leader as his biological father, at a place other than the court complex.
The 88-year-old leader, who was to appear today before a court appointed Local Commissioner for cross examination by the counsel for 32-year-old Rohit Shekhar and his mother Ujjawala Sharma, said his lawyer would move an application before the appropriate bench, where the suit is pending, for shifting of the venue.
Tiwari's counsel asked the commissioner to defer the cross-examination of the matter, and also sought further time to file the affidavit in evidence.
The commissioner S M Chopra, Retired Additional District Judge, after recording the submission of the counsel concluded the recording of evidence.
"The counsel for defendant (Tiwari) submits that whatever date is fixed now, he will be available for cross examination at some venue other than the high court premises for which, he seeks permission from the high court. He further submits that the commissioner may fix a date for cross-examination of the defendant....In the meantime, may move an application for recording of cross-examination at some other place.
"....In the absence of affidavit in Evidence of the defendant, the recording of evidence by the commissioner stands concluded," the commissioner said.
