Permanent disability in accident, man gets Rs 29 lakh damages

A motor accident claims tribunal (MACT) has awarded a compensation of over Rs 29 lakh to a man who suffered 75 per cent disability in a road accident in 2012.
MACT presiding officer Amit Bansal directed the Reliance General Insurance Company Limited, insurer of the offending vehicle, to pay Rs 29,70,377 to north west Delhi resident Rajeev Kumar.
The tribunal noted that as per the medical certificate, Kumar was suffering from permanent disability of 75 per cent in the right side of his body.
"The medical condition of Kumar and the specific testimony of prosecution witness 5 (member of the medical board) would also show that he would not be in a position to continue his business of making duplicate dental structures and hence, the functional disability of the petitioner can be safely assessed at 100 per cent," the tribunal noted.
On October 31, 2012, while Kumar was on his way back to home on his motorcycle, a truck hit his bike from behind at Kanjhawala road in north west Delhi, he told the tribunal in his complaint.
The driver and the owner of the vehicle denied that the accident was caused due to rash and negligent driving.
"Since the offending vehicle was duly insured, Reliance General Insurance company Limited is directed to deposit the award amount of Rs 29,70,377 with interest," the bench said.
