A petition seeking a compensation of Rs 50 crore from Tamil Nadu Home secretary, DGP and a CB-CID inspector was filed in the Madurai Bench of the Madras High court by five persons, who were acquitted in a murder case by a trial court.
Admitting the petition filed by Rangiyah, his sons Jaya Kumar and Jayaram Jothi and their two relatives, Justice R Subbiah ordered notice to the concerned officials.
The petitioners submitted that they were arrested in connection with the murder of one Rajesh Babu when he was travelling in the Mumbai-Nagercoil-Tirunelveli train on January 13, 2008.
The Nellai Railway Police and the local CB-CID police, who investigated the case, "had almost zeroed in on the real accused when the investigation was transferred to the CB-CID Inspector Marirajan of Madurai under influence".
"Marirajan arrested me, my two sons and two others in connection with the murder. He also concocted the case as if the train passenger Rajesh Babu was murdered following a quarrel over travelling in the reserved compartment without reservation."
"My two sons, who were highly qualified were to work in London for a salary of Rs five lakh per month. My nephew who was a Government official also was suspended. My daughter's wedding that was to take on the date of our arrest also did not take place because the groom side left the wedding hall thinking that we are all criminals."
The Tirunelveli district and sessions court judge had on November 19, 2011, acquitted all the accused including the petitioners, saying that they were not the real accused and the police should find out the real accused.
The petitioners said they had been in jail for no fault of them and underwent all the agony. Police had also not found the real culprit so far though they had closed in on him. Hence the case should be transferred to the CBI and each one of the five accused should be given a compensation of Rs 10 crore each, the petitioners submitted.
