The Bombay High Court today sought Maharashtra government's response to a petition seeking a CBI probe into the alleged role of Pune police in falsely implicating the complainant in a murder case.
The PIL, filed by former journalist Ketan Tirodkar, says that Nilesh Jadhav had filed a police complaint after witnessing murder of a man by members of a local criminal gang who were later arrested under the Maharashtra Control of Organised Crime Act (MCOCA).
The incident had taken place on February 1 this year. The arrested men belonged to the infamous Marne gang.
However, later the Paud police in Pune registered a false case under section 399 (making preparation to commit dacoity) of Indian Penal Code against Jadhav who is a driver.
According to Tirodkar, there is a nexus between Pune police and the local gangsters and the police filed a false case against Jadhav when he refused to withdraw the complaint in the murder case. He was arrested and lodged in the same jail as the accused in the murder case.
Several sensitive cases in Pune area, including the murders of RTI activist Satish Shetty and anti-superstition crusader Dr Narendra Dabholkar are yet to be solved because local police sabotaged the investigation before the cases were handed over by High Court to CBI, the PIL says.
