Taking up an application filed by advocate Pravat Ranjan Dash, who is representing some charge-sheeted doctors in the case, Justice Mohanty issued the notice to the state government and fixed November 22 for next hearing on the application.
The Women's Commission in February 2012 had submitted its report to the state government observing alleged negligence on the part of the doctors in treating the victim and not informing the police on time.
"As per law, if any information is received by the doctor regarding partial hanging, it was the duty of the doctor to inform the local police and treat the case as medico-legal. Had that been done, the police would have initiated immediate action," the report said.
Similarly, when the victim was brought to SCB medical College and Hospital in Cuttack on December 14, 2011, the doctors at the teaching hospital discharged the victim on the request of the victim's parents without giving her treatment or referring her to any other better facility, the Women's Commission report had said.
