Police cant inquire disputes between landlord, tenant: HC

Making clear police is not entitled to inquire into matters where a landlord and tenant relationship existed, Madras High Court has held the parties should be asked to approach competent civil court or the Rent Control Authority to sort out their disputes.
"It has to be pointed out that if there is a landlord and tenant relationship, the Police is not entitled to inquire the matter. It should advise both the parties to approach before the competent Civil Court or Rent Control Authority," Justice T S Sivagnanam observed disposing of a petition by a tenant.
Petitioner R.Suresh submitted he was a tenant in the Parsan Complex in Anna Salai here owned by P Syed Omar Sajeeth. The owner had lodged a complaint with police seeking his eviction for 'non-payment' of rent, following which the Teynampet inspector issued notice asking him to appear before him.
Accordingly, he along with his Counsel Namo Narayana appeared before the Inspector and informed him that there was no criminal offence made out.
Then the Counsel for the petitioner approached the high court with the present Petition, seeking a direction not to harass his client.
Disposing of the petition, the Judge said Police had no role in the matter between a landlord and tenant related to tenancy.
