Metropolitan Magistrate Ambika Singh, who had earlier directed SHO of Civil Lines Police Station and investigating officer to appear before the court with a detailed status report, granted time and fixed the matter for November 3.
The SHO told the court that reply of Delhi Assembly was awaited and the report would be filed after receiving it.
Earlier, advocate and RTI activist Vivek Garg, who has filed the complaint, had objected to contents of the police's report saying by forwarding the complaint to the Assembly, police has disclosed the identity of the complainant before Tripathi who could tamper with the evidence.
The court was hearing a complaint alleging that an the MLA from Model Town constituency here committed an offence by getting his mother's medical allowance worth over Rs five lakh reimbursed from Delhi government, despite his parents not being dependent on him and not entitled to the claims.
He sought registration of an FIR against Tripathi for alleged offences of cheating, criminal breach of trust by public servant, forgery for cheating and criminal conspiracy under the IPC.
The complainant has claimed that Tripathi had obtained a medical facility card under Delhi Government Employees Health Scheme and to obtain "wrongful gains", he has disclosed in the card that his parents are dependent on him and can avail the medical facility on the card of an MLA.
