The police want to book Vora, who had allegedly helped gangster Vijay Palande escape from custody, under section 225 (5) (obstruction to lawful apprehension of another person) of the Indian Penal code, which carries the maximum punishment of seven years' jail term.
On July 7, the Magistrate's court had sought clarification as to whether Crime Branch was going to apply section 224 (obstruction by a person to his lawful apprehension), or the section 225. Maximum punishment under section 224 is only two years' jail term.
On April 10, Palande escaped after he was arrested for the murder of Delhi-based businessman Arun Kumar Tikku.
After giving police a slip, he allegedly contacted Vora. Vora met Palande near Marine Lines in south Mumbai and they went to Colaba and bought three T-shirts using Vora's credit card, police say.
The two then went to a hotel where they stayed for an hour.
However, Palande then went to Churchgate station, where police nabbed him.Vora was arrested by Crime Branch on April 22,and was released on bail by the High Court later.
