The court was informed that the process of service of summonses is being done in accordance with the Mutual Legal Assistance Treaty (MLAT) between the two countries.
Metropolitan Magistrate (MM) Jay Thareja, who posted the hearing for October 26, was told by advocate S P M Tripathi, appearing for complainant Vinay Rai, that the filling of forms required under the treaty on the issue was on and would be completed today.
"I am filling the forms and have consulted a retired official of the Ministry of Home Affairs (MHA) for his help in filling the forms," Tripathi told the court.
The court also issued summons against Amar Chand, Under Secretary, MHA, directing him to appear before it on the next date of hearing.
Amar Chand had earlier suggested to the court to start extradition proceedings to secure the presence of the US-based websites and had referred to the MLAT between the US and India saying that instead of issuing summonses against them, it should initiate extradition proceedings.
The court, however, had said that it would not initiate the extradition proceedings against the websites and asked the official to assist the complainant's counsel in filling the forms for service of summonses. (more)
