Project to cut down on pendency of trade mark disputes

The Indian patents and trade marks office and Delhi State Legal Service Authority (DSLSA) have decided to start a project for reducing pendency of trade mark disputes through mediation.
"In view of the pendency of opposition/rectification matters at Trade Mark Registry, Delhi, the office of Controller General of Patents, Designs & Trade Marks (CGPDTM) in collaboration with DSLSA has undertaken to initiate a project to liquidate such pendency through mediation/ conciliation based on mediation/conciliation rules framed under the Legal Services Authorities Act, 1987," CGPDTM said in a public notice.
Initially, it was decided to undertake the project on pilot basis by taking 500 pending opposition/rectification matters.
But, it said, now the office has decided to invite consent from concerned parties in all the opposition/rectification proceeding pending in the Trademark Registry and final hearing has not been concluded.
It added that the interested parties may submit their consent in the 'Consent Form' within 30 days from the date of this notice, so that their matters may be referred to DSLSA for further action.
