Yadav, who has featured in films like 'Massey Sahib', 'Lagaan', 'Peepli Live' and 'Gandhi to Hitler', had moved the sessions court against an order of a magisterial court in October last year asking him to pay the maintenance saying that he was doing well in commercial cinema.
Additional Sessions Judge (ASJ) T R Naval granted time to Yadav to pay arrears to his estranged wife observing that his revision petition would be heard on merits only after he will comply with the order of the magistrate.
"Revisionist (Yadav) has prayed time of two months to deposit the arrears of maintenance in the court. Accordingly, revisionist is granted two months time to deposit the entire arrears of maintenance in the court or to pay entire arrears of maintenance to respondent (woman) on or before two months," the court said.
During the arguments on the plea, counsel appearing for the woman had told the court that the revision petition cannot be entertained unless Yadav deposits the upto date arrears of alimony of over Rs 10 lakh.
The court also observed that if the dues are not deposited by Yadav, his petition may be "dismissed as not maintainable".
"Therefore, on applying the principles of law... I am of the view that the arguments of counsel for respondent (woman) is convincing to the effect that this court can hear revision petition of the revisionist on merits only after compliance of the order of deposit of upto date arrears of maintenance as passed by the magistrate," it said.
