The New Delhi District Consumer Disputes Redressal Forum ordered U-Turn Housing to pay Rs 50,000 as compensation to city resident Anjula Malik, besides his Rs 2 Lakh paid as the cost of plot.
Observing that the firm had promised to deliver the plots within six months but did not do so even after a year, the forum headed by C K Chaturvedi also held it guilty of rendering deficient service.
"At the time of booking, opposite party (U Turn Housing) promised that possession of plots will be given within six months... Allotment was not given even after 12 months. Since, the project was delayed and complainant (Anjula Malik) was not interested in taking the possession. Therefore, she requested for cancellation and refund of booking amount.
"The allotment got cancelled. But on demand opposite party failed to refund the booking amount. So, there is deficiency on its part. Holding it guilty of deficiency in service, we direct it to refund Rs 2,00,000. We further award Rs 50,000 as compensation towards harassment including litigation cost," the forum said.
Anjula Malik in her complaint had said she had paid Rs two lakh for booking two plots of 300 square yards each in the firm's upcoming project, Silver City, in Jaipur.
She had added that the firm neither alloted her the plots in time nor did it refund her money when she asked for it.
She had also submitted to the forum that as per the Jaipur Development Authority, no approval was granted to the firm for its upcoming project, nor any allotment of land was made in its favour.

In its reply, the firm had said it had obtained all the required approvals from the government and added that Malik's allotment was delayed as she had defaulted in making payments despite reminders.
The forum rejected the contention of the firm saying it had "never placed any documents or reminders pleaded as by it in written statement, to substantiate its plea."
