Remove encroachment from railway land within 4 weeks: HC to

The Uttarakhand High Court today ordered removal of encroachment from railway land in Haldwani within four weeks.
The land is spread over acres and almost thirty thousand people reside there.
The encroached lands house hundreds of residential houses, many schools, shops and other establishments.
Earlier, the high court had issued direction to get the land vacated, but the issue was politicised and the government had asked for additional time on various grounds.
The high court today took a stern view on this and ordered removal of encroachment within four weeks.
Taking cognisance of the fact that the issue was politicised, it also ordered any public figure or political leader need not comment upon this order.
The high court dismissed a review application filed by the state to stay the removal of encroachment from the premises of Railway Authorities' Gafur Basti at Haldwani.

On November 9, on a PIL filed by Haldwani-resident Ravishankar Joshi for the removal of encroachment from Gafur Basti that had come up on railway land over the years, the high court had directed that the encroachment be removed within three weeks.
The division bench of Justice Rajeev Sharma and Justice Alok Singh had also directed the Senior Superintendent of Police (SSP), Nainital, to provide the necessary police force.
The state today filed a review petition before the court pleading that the previous order be negated or at least six weeks' additional time be granted to carry out the orders.
The state argued that board examinations are about to begin and the premises in question contain at least three school complexes.
The court granted the state four weeks' time to provide for the required police force and equipment to carry out the orders.
It was further directed that if the state fails to provide force within four weeks, the Railway authorities may approach Central Reserve Police Force for help.
The high court directed that alternative examination centres must be provided for.
"It is the duty of the state government to provide protection and a failure to do so is the failure of the constitutional machinery," it said.
