Dr Desai and Dr Kumar had contended that all proper and reasonable care was taken while performing the test, but she had suddenly developed breathing difficulties and suffered cardiac arrest after the procedure was completed. They had also contended that they immediately provided her with oxygen and performed cardio-pulmonary resuscitation (CPR) to revive her and hypoxia had not occurred during or after the test. This contention was rejected by the commission which said the doctors' assertion was in conflict with the certificate of Care Hospital which said the patient was brought to it in comatose condition and had suffered brain damage due to hypoxia which occurred after the test was conducted.
