The court also granted right of residence to the woman to stay at her matrimonial house and restrained the man from dispossessing or disturbing her from "peacefully enjoying" the ground floor of the premises without due process of law.
"Keeping in view the earning and the admission of the respondent (man) and in the interest of justice, I hereby grant maintenance of Rs 6,000 per month in favour of the petitioner (woman) and against the man," Metropolitan Magistrate Ekta Gauba said.
The woman said they had married in March 1972 and till 1996, their marital life was smooth but after that the man's behaviour towards her and their three children allegedly became rude.
She alleged that the man was a habitual drunkard and he refused to perform his duties towards them.
The man had also filed a false petition under the Hindu Marriage Act against the woman in which the court had passed the decree for judicial separation and she had preferred an appeal of the order, she alleged.
