Road accident case: Tribunal pulls up DTC, insurance firm

The DTC and an insurance firm have been pulled up for trying to avoid their responsibilities by a Motor Accident Claims Tribunal which awarded compensation of over Rs 17 lakh to the kin of a 17-year-old boy, who died in a road accident due to negligent driving of the bus driver.
The tribunal said though all have sympathy for parents who lost their only son but none was inclined to help them and directed United India Insurance Company Limited, with which the offending bus was insured, to pay Rs 17,62,924 to the kin of Mohd Sahil.
MACT Presiding Officer Madhu Jain said the parents of the victim have been able to prove that Sahil had suffered fatal injuries due to rash and negligent driving of the driver of Delhi Transport Corporation (DTC) bus.
"Despite numerous guidelines laid down by the Apex court and our High Court, again and again the insurance companies or the government transport authorities rake up this issue. Nobody sees the condition of the old parents who lost their only son.
"DTC officials in connivance with its driver are passing the buck on the insurance company and insurance company is trying to avoid its responsibility saying that insured has violated the terms and conditions of the insurance policy," the judge said.
According to the petition filed by the victim's parents, on November 14, 2013, Sahil was driving his two wheeler and when he reached near a hospital in Jamia Nagar here, a DTC bus which was being driven in a rash manner hit his scooter from behind due to which he fell down and suffered injuries.
He was rushed to a hospital but was declared brought dead by doctors. An FIR was lodged against bus driver Anil Kumar.
Police said during investigation, it was found that the accident was caused due to rash driving of DTC bus driver.
