Road accident victim's family gets over Rs 10 L compensation

A motor accident claims tribunal (MACT) here has awarded a compensation of over Rs 10 lakh to the family of a 56-year-old government employee, who was killed in a road accident in Uttar Pradesh in March 2008.
MACT presiding officer Amit Bansal directed the Reliance General Insurance company Ltd, the insurer of the offending vehicle, to pay Rs 10,10,836 to the wife and five children of Diwan Singh, who was a resident of Jahangirpuri here.
"It is prima facie proved that the man died as a result of injuries sustained in the accident due to rash and negligent driving of respondent number 1 (the driver of the vehicle)," the tribunal said.
On March 3, 2008, Singh, who was posted as an assistant development officer with the Department of Agriculture at Shahjahanpur in UP, was on his way home when a jeep hit his motorcycle from behind, the family had told the tribunal.
However, the driver and the owner of the jeep had claimed that no accident took place involving their vehicle on that day.
The tribunal noted that the insurance company was unable to show anything on record to prove that the driver of the jeep was not having any valid driving licence.
"Since the offending vehicle was duly insured, respondent no 3 (insurance firm) is directed to deposit the award amount of Rs 10,10,836 with interest," the bench said.
