The tribunal directed Shriram General Insurance Company Limited, with which the offending vehicle was insured, to pay Rs 45,28,000 to the wife, two kids, parents and two sisters of Sunil Kumar.
"In view of the above discussions and particularly in view of no controverting evidence on behalf of driver of the offending vehicle, it stands proved on record that deceased Sunil Kumar had sustained fatal injuries due to rash and negligent driving of respondent no. 1 (truck driver) on August 13, 2013," MACT Presiding Officer Prem Kumar Barthwal said.
The accident took place on August 13, 2013 when Sunil was on his motorcycle and the offending truck driven by Jaipal hit him. Sunil was taken to AIIMS trauma Center where he was declared brought dead by the doctors.
Sunil's wife told the tribunal that he was working as a field supervisor with a private detective company and was earning Rs 18,000 per month.
The truck owner and driver, in their written statements, denied the claims of the victim's family and contended that the accident had taken place due to negligence of Sunil and their vehicle was falsely implicated by the claimants in connivance with the police just to get compensation from the insurance company.
