SC asks Centre to expeditiously decide TN IPS Officer's plea

The Supreme Court today asked the Centre to expeditiously decide a senior woman IPS officer's plea against her suspension ordered by the Tamil Nadu Government for joining the CBI without being relieved by the state.
A bench headed by Chief Justice H L Dattu asked the concerned department to look into the plea of IPS officer Archana Ramasundaram after senior advocate Siddharth Luthra, appearing for her, said that Centre has the authority to revoke the suspension ordered by the state government.
However, the bench did not go into her plea seeking clarification/modification of May 9 order restraining her from discharging her duty as Additional Director in CBI and asking her to first get the suspension order repealed and then it will consider her plea.
The officer was allowed to withdraw the application in which she stated that the stay order was coming in the way of her promotion to the rank of DGP.
She had sought clarification that the Centre can consider her empanelment for the rank of DGP in para-military forces like BSF.
Attorney General Mukul Rohatgi informed the bench that the officer had joined the CBI pursuant to the Centre's direction and there was no relieving order from the state government.

Tamil Nadu government also submitted that the IPS officer joined the CBI without being relieved by it.
The state government submitted that she joined CBI on May 8 and on the same day she was placed under suspension and she cannot be promoted till that order is revoked or stayed.
Taking note of the submission, the bench observed, "rightly or wrongly you are under suspension. Can we ask the Centre to appoint you for higher post when disciplinary proceeding is pending?"
The bench also said that she could approach the Central Administrative Tribunal for relief.
Earlier, on August 19, the court had refused to withdraw its order restraining Ramasundaram from functioning as Additional Director in CBI and the Attorney General had conveyed his view that the only way to now sort out the issue was that she goes out of the agency.
