The Supreme Court today refused to direct CBI probe in the murder of seven-year-old Yogita Thakre who was found dead in a car parked at former BJP president Nitin Gadkari's home at Nagpur.
A bench headed by Justice R M Lodha dismissed the PIL seeking its direction to transfer the probe from state CID to CBI alleging that the state agency has not conducted a proper probe in the case as Gadkari's name has also come up.
Rejecting the plea filed by one Kishore Samrite, the bench said it is for the Magistrate to decide whether the probe has been done properly or not on the basis of the report submitted by the CID.
Yogita was found dead under mysterious circumstances on the back seat of a car parked at Gadkariwada on May 19, 2009.
Her parents Ashok and Vimal Thakre had filed a petition in the Mumbai High Court for transfer of investigations in the case to state Criminal Investigation Department (CID).
The High Court had transferred the investigations to CID after they alleged that the city police were trying to suppress the probe and conceal evidence to shield the offenders.
